I was looking at the contridiction page and saw this one:



Then I noticed there is a possible explanation to this one.

Max had simply already stolen Trilo and Ben did NOT have him at the time Russel went by.

First note, Ben's character. He CANNOT speak without Trilo. So when he was being questioned he added Trilo to the story in order to tell his perspective through/as Trilo.

The picture could be explained in the same way as the Wellington/Maggey/Dustin picture where Wellington was on the ground by the body and Maggey was present at the scene. That it was to add emphasis to the story.

So what do you think about my theory?

That's what I thought! Either that, or there was a period where they hadn't collected enough evidence to claim Max as the killer and he could of done it then.

The problem is, if Ben can't speak properly without Trilo, then Trilo testifying that he said "Good Evening" couldn't happen could it?

Well, he could've said:
"G-G-G-G-Good evening..." in a really quiet voice.
Which means Russell probably didn't hear him, and just walked right past.

There's a thread for contradictions in the defense lobby. If you want to discuss it, bring it up there.

Though the problem with saying that Trilo wasn't there is that they were standing outside waiting for Regina so Trilo could propose. If Ben didn't have Trilo with him, there wouldn't have been any reason for him to be out there.
