Here's the official description Lee Nash was burning brush in the backyard of his summer residence. Sparks from that fire allegedly caused a fire to break out in the nearby State Campground where Larry Lumina was camping. Mr. Lumina was asleep in his tent when he was overcome by the smoke and died. Nash is now charged with homicide by negligent handling of fire. |

Heh. I'm not sure what my mock trial is about. Tomorrow is when we find out. Apparently my friend wants to be the accused and wants to defend himself in court. I said "Good luck with that." I asked if I could be the defense or prosecution. I just wanna say...

Defense in mock trials is always rigged to win because they always place little loopholes for the defense to use like the arresting cop has history with the defendant or something. |

Well, it's been quite a while since the trial ended and my client was proven to be guilty. The prosecutor? MS.WRIGHT! I finally found some proof and asked my teacher if we were going to do any more mock trials. He said, "Absolutely not." I plan to give him the materials for him to read over, and to reconsider. ![]() PS I did shoot down one of the witness' testimony. That was fun!!

Really vague topic for me because I'm too use to details such as location, state laws, psychologic issues and whatnot. As for where I am living, burning a single thing is illegal due to fire storm hazards. On the charge for negligent homicide, the defense would have a hard time because homicide does not have to be intentional (that's murder), therefore a motive does not have to be established. Because it is a STATE and public campground, Lee should have known better that burning a single damned thing is unlawful (unless Lee is a minor and being charged as one, then he can claim no knowledge thereof). I've gotta collect my thoughts on this, way too many vague ideas flowing through my head right now. |
