According to two Programmers who work for Datel (the company who makes the Action Replay and many other kinds of preheps and third-party accessories), they're about ready to throw in the towel. Although they succeeded in reverse engineering all three systems (thanks in part to the fact that all three are also backwards compatible with last-gen games), they've reached a point in coding the Action Replay which, should they cross they run this risk of legal action from one and/or all of aforementioned comanies (Nintendo, Sony and Microsoft).
Unlike the last gen, the current gen requires periodic firmware upgrades to run new games. The concern is in order to make the AR run, they'll have to mod the firmware and Nintendo has reportedly already "promised" legal action should the AR Wii they're working on comprise the integrity of the Wii Shop Channel (of course, they're talking about people being able to either get free Wii Points or get VC/Wiiware Games for free). Interestingly, the only reason Datel's getting away with the DS (not the DSi) is because of course, it doesn't require firmware upgrades (though the DSi hasn't required any yet, there's a chance that could change since it's interface is similar to the Wii).
Microsoft's policy of instantly banning access to Xbox Live from modded systems has scared away all but the most hardy and dedicated modders. For those who don't know, this policy was adopted to combat the huge number of modded Xbox (not 360) systems used to play ROMs (mostly NES, Genesis and SNES, of course), etc.
Of course, enthusists would applaud all three companies for going out of their way to keep the current gen cheat free. Many people were and still are worried about the prospect of playing someone online who uses a hacked game to have an unfair advantage. It's already been shown on the DS the kind of damage an AR can do to the Online Community*. No one's gonna want to run the chance of playing online knowing their opponent might be cheating.
Me personally, I'd welcome an AR for the current gen provided they only work in offline play XD
As for who those two are...I don't feel comfortable naming them. I got this info direct from Code Junkies' Website XD
*This is of course in referral to Metroid Prime Hunters. The AR DS was released a few months after MPH was and prettymuch destroyed compatative play. MPH was recently succeeded by Call of Duty: World at War and similar issues have arisen.
