Shouldnt Phoenix have lost his badge? (3-3 and AJ spoilers)

I just finished 3-3 of T&T but wondered shouldnt Phoenix have lost his badge, or at least been punished in 3-3 because he said the final evidence (the small bottle) was fake/useless, and he KNEW that ("It doesnt matter whose prints are on the bottle now) and he kept calling it "phony" evidence, yet in 4-4

He did not make that evidence, it really was at the crime scene. And it's legal to bluff. It's not worse than accusing someone (supposedly innocent) with murder.
