So we know that Luke Atmey was, in fact, not at Lordly Taylor at 1AM on the night of the murder. Instead, he was at KB Security committing a murder. So how did Luke Atmey move the statue during the night if he wasn't there to begin with? If we recall, Phoenix, Maya and Pearl saw the statue in front of the paint and it was around 7PM when they left. When did Luke Atmey have a chance to move the statue?

When nobody was looking.

Which is pretty much the whole night minus the murder episode and the thirty minutes it takes to travel between both locations (or one hour round-trip, if he moved the statue after the murder). He obviously wasn't at KB Security the whole night.

Isn't it said in-game that the photo was taken the day before Luke killed Bullard?

It was definitely taken before Luke killed Bullard. At least, some time before the statue of Ami Fey showed up.
