Basically, I looked up malpractice. It can be murder. In other words, I lose you win.

Well not really...
But fancy a double murder here...
The 'killer' kills a victim (I'm thinking laboratory setting). Then when an associate comes in to collect some papers the Killer is forced to hide in between two large containers by the wall opposite the desk with the papers. The Killer is holding the body up in front of him (Solid Snake style) and places the gun in the corpses hand and clasps his finger around the corpses hand helping the dead man to aim and kill the potential witness.
This way the first victim would get the blame as it looks like he killed his colleague before taking his own life out of guilt.
However the police if they came to the conclusion that the killer was the first victim wouldn't bother taking it to court seeing as the murderer was dead so maybe this is more of an AAI case than a courtroom case.

Though a cool one would be something like locking someone in a parking garage with all the cars on (not sure how that would work) and they die from carbon monoxide. It'd take some thinking to get that thought into motion, I guess.

Scaring people is highly ineffecient... you might FAIL to kill the person, actually, so poison ensures that he stays dead :D
On the other hand, though, I'd prefer bacteria to do the dirty work for me. Harder to trace, and it can be naturally occurring too...
