Maybe, 5-5 (yes, I'm assuming 5 cases) will be like 2-4, where it'll be an epic filler case.
I got it! It was a complex, fully planned (even with a fall guy) metophorical time bomb (somewhat like 4-4), but the criminal died while waiting for it to go off.
I think that'd just be epic.

he could fake his death, influence the prosecutor (franny or edgeworth) to think it was someone who killed him while the whole time the trial is going on he leaves forged evidence everywhere pointing to apollo's client. the prosecutor wins. Okay everything after this is like a cut scene or something. At apollo's next trial phoenix walks in and reveals that he did this all to kill someone that Blackmailed/wronged him something like that and makes some kind of phantom of the opera disaperance and then next game title comes up. (next game, something to do with investigating phoenix or something so like it could be about everyone trying to find phoenix and stuff)

How would people feel if the victim of the last trial of GS5 was none other than Phoenix Wright?
Well Capcom decided "HEY! Here's a great idea! Let's make sure Phoenix gets hit by a car flying into a pole! Also make sure that he isn't hurt people don't like pain >.>"
So yeah I could see Capcom killing them off...

How about...:
The night before an important case, Apollo stays up late doing something, but goes to sleep at 5:00 AM and dreams about the case, and what happens. He wakes up in the final moments of the case and sees that he could just make it to the courthouse in time.
Then, Apollo uses his dream knowledge to take the case down easily.

I've been known to be slightly cynical on some matters, and corporations are in no way exempt. Capcom probably cares about the money gained from production of these games, and this possibility would be detrimental to their cash flow. After all, if Phoenix were to die, a large fan base would be lost immediately. The same goes for if he murders someone or, say, forges to get an incorrect "Not Guilty" verdict, or something among those lines.
Therefore, Capcom would not do it.
I know, of course, that this is purely a conversation, and quite interesting, too. I personally believe that, although the possibilities raised by this hypothetical situation show promise, the situation would have to follow this criteria to still be one of the Ace Attorney cases we know and love:
1. Phoenix Wright could not fully die. Then he would just be...well...Blackbird Wright.
2. The effects from whatever Phoenix has done could not be life-scarring (because we all know how quickly everyone gets over these cases!)
3. His moral code could not be too thoroughly compromised.
4. If he disappears, like Edgeworth, one airplane scene might be nice.
5. If Phoenix Wright does indeed come back from the dead, so to speak...
Apollo would have to punch him in the face.
Hard.
Anyways. I might not even be talking about what everyone else is anymore C=

Well... most of your post, but mostly this
There are two distinct impossibilities here. Capcom killing off Phoenix is one, but the other impossibility is that nothing dramatic happens concerning him in the final case. Apollo or not, the Ace Attorney games are central to everything that Phoenix does. The series at its heart is still about Phoenix Wright, and Capcom would mar that and lose points with fans by not including him as the key player in an intense case.
