"Didn't you read the report? It said that 'Al had an argument with his wife... causing the defendant to use his gun on his wife. Since his children witnessed the act, he had to kill them as well'-- in other words, they were killed as a result, ci? Also, what Detective Palochini just said: 'The kids ran for help, but started in a way that allowed him to shoot their front'... or something to that effect." Lucias said, reading over some notes and evidence.

"Like I said, even if we were to debate it all day, the facts are still there." He said, in a 'matter-of-fact' tone.

"So, how were they arguing? Do you claim my client was sitting or standing?" Martha asked, suddenly struck with inspiration by the prosecutor.

"I see where you are going with this." Lucias said perking up, grinning a little. "I wasn't there, remember, so I myself can't tell you. Again, this is all details I just repeated to you from the reports, witness accounts, and current proceedings. If you wanna ask our current witness, I wouldn't object. Some twists and turns will make things interesting."

He pulled the sucker out of his mouth and leaned on that arm. "But! Don't blow this, Miss. You seem pretty lost for the whole situation, so you might make the wrong assumptions... and that's why, to make sure you actually grasp the seriousness of things, I say we instate a penalty if you waste our time. Your honor? Any objections?"

Martha gulped nervously. A penalty? I'd better not screw up, she thought. If this is the only chance I have to save my client, if only for a day, then I'll just have to risk it. Martha nodded solemnly to signal that she accepted the terms.

"Yes, we do not need to hear any more obvious answer to obvious questions. If an argument arose while they were eating dinner, we can assume that they were all sitting at the table until the defendant and his wife started to argue. From what I can tell, the defendant remained seated when he shot his wife. Since his children were sitting on the opposite side of him, there would not be any burn marks where the wounds are. Am I right, Mr. Palochini?" The Judge asked.

"Yes your Honor." Fernando replied.

"Very well, I'm penalizing Ms. Fey for such questioning. Please pick another line of questioning." The Judge asked Martha. "If the next question is just as obvious as the other ones were, I'm going to have to penalize you once again."

'Oooooh... even before we started.' Lucias thought, almost flinching. 'I was gonna let her have some more leniency than that... Judge must be having a bad day or something.'

"Right, Miss Fey, the witness is all yours. What do you wanna ask?" He said, replacing the candy back in his jaws and crunching over the evidence again.

*gulp* "W-wait, Your Honor, I-" Martha began. BOOM! Maybe I should rethink that one. But even if they were on opposite sides of the table, I think that would be close range...Gah! Never mind that. Pick up the pieces of your shattered momentum and get this client to reveal something. Anything. Perhaps some new evidence.
"At what table were hey sitting at? Could you show me via floor plans?" Martha asked.

"Ooh! I knew there would be an easier way to determine their assumed locations before the murder!" Lucias said. He quickly crumpled up a small sheet of paper in front of him, with a series of rudimentary drawings that looked like what he had imagined the floor plans to be upon it. "Do we have a copy of the floor plans available for the records?"

Thib watched the trial with a detached interest.
I wonder, he thought, whether there was anybody else in the restaurant at the time of the murder?
"And what does the defendant say happened? This is getting interesting..."
He writes "The scene is established. Floor plans will be produced. Will the defense find a contradiction?"

"Wow...this is defiently worth the money"

Asuka had kinda been in a certain zone...she couldn't hear anyone or anything when she was really interested in something. It was something she was not to proud of... She finally noticed that Thib was writing things down.

"How cool...I think he said he was a freelance writer...That sound more exciting then fixing bugs and being yelled at...

(ooc: Ah, but the compensation is that you only get paid if someone likes your story.)
Thib glanced up and saw Asuka looking at him. He grinned nervously.
"I get stared at a lot. With my hair and all?" Maybe I should stop dying it blue... he thought. purple, maybe?
"I don't think I ever got your name. Oh!" He started writing again.
"Let's make this professional. Can I quote you?"
Without waiting for an answer, he plowed on, once again. "So what do you think of the trial so far?"

Thib wondered about that. "Really? Funny... I haven't heard anything...
Of course, that doesn't mean much in my case. People like to read about guilty verdicts.
I wrote a story on a defense attorney once... never got published."
He sighed. "I thought it was interesting. Different angle, you know?"

Thib scratched his head.
"Em, I've got a terrible memory for names. Like, yours was Sarah, right?
No, wait... Asuka. Yeah. That was it. ...I think...
Anyway, I'm pretty sure his last name was Wrong. No, that's not right...
Trite, maybe? I feel like I'm close to being right... Hm.
Anyway, he mentioned being descended from a very good defense attorney.
Well known, too. But I suppose it was easier for a defense attorney to be renowned then.
Now, I don't like interviewing prosecutors. They act so... arrogant. They talk a lot too."
Thib gasped.
"I'm sorry, I'm rambling again..."

"No thats fine. Let me think...Wrong? Huumm....I think I knew someone with a last name wrong...Poor guy was picked on daily..."

Asuka was about to ramble on about the people she knew when she heard Thibs thoughts on the prosecutors.

"You think so too? They all ways seem so arrogant today...From what I read about some past ones were pretty cool, a bit on the weird side, but cool. Todays...I don't like them..."

"Does it matter?" Fernando asked. "Everyone in the room freaked out when they heard the gunshot - at least that's what I heard. I also heard that the chefs stopped cooking because of it."

"So just to clarify," Lucias said, butting in. "your saying that: a) When Al started shooting, the people in the place panicked, and blindly fled; and b.) the chefs also fled, leaving their meals in mid-preparation, yes?"

"Just wanna get all the facts straight, for Miss Attorney's sake." He said, afterward, with a smile at Martha, like how a teacher would smile at a student who only just figured out the answer to a simple question.

Thib began to squirm with excitement. "I think I found a contradiction." He smiled and started scribbling on his notepad.
When he looked at what he had written, he frowned. "I wrote too fast. I can't read it." He scrapped that page and started a new one.
As he wrote, he explained his thoughts to Asuka.
"The defendant shot his wife. He then shoots his children because they witnessed the act."
Thib scratched the back of his neck. "But there were others in the restaurant. Why would he only shoot his children?"
Thib smiled. "Also, we need to know exactly who was sitting where. Depending on where they were at the table, the whole circumstances of the murder could change."
His eyes sparkled. "Gunpowder burn. There was gunpowder burn on the wife, but not the children. If their positions contradict the gunpowder burn or lack thereof... Also, they were in the corner. The children tried to run. How far did they get?. Their directions were limited, unless they could run through walls. So there's another possible contradiction, if the one who got shot in the chest had his back to the defendant."
Thib was practically jumping out of his seat. "This is so exciting!"

"Yes, that's correct." Fernando said, confirming the situation.

Don was annoyed by Thib's explanation, but he couldn't express his thoughts. He was mad, and you could see it.

Martha despised that smile the pesky prosecutor gave her. No, don't rush into anything. Remember: get all the evidence you can and plan everything carefully.
"That's important, Your Honor. The information should be added to the testimony," Martha said. "Also, do you have the gun these bullets were fired from?"

Fernando pulled out a plastic bag with a gun in it. "Right here." He said, handing it to Martha. It was a handgun, just as the autopsy report said.

Lucias was counting down until he had to pipe in. He had gotten onto the count of 2 when Martha had made her comment.
"I think" He said, not bothering with the objection again. "That it should be obvious. If Al was visible but his wife wasn't, then the only possible location for her would be opposite the wall corner-- that way, when Al stood up, he could be seen, but she could not, and the children could attempt to flee. Isn't that right, Detective?"

"I'd also like to make a mention for the records," Lucias added. "that the majority of the restaurant patrons also refused to testify today, because, while only a few saw the actual shooting, the rest did not actually see it, either completely or directly, according to what they (the patrons interviewed, Martha) were willing to give us."

Martha looked at Don, picking up on something. She couldn't place it, but she knew Fernando was going to say something different. Perhaps. Martha then looked back at Fernando.
"So could you show me on the floor plans where they were at the table?" Martha asked. This will help a lot, I hope.
