The redhead in the audience raised an eyebrow at the witness's response. It seemed to her that checking for witnesses, no matter how riled up a murderer was, would be the natural thing to do.

"Well I did hear 6 shots." Bill told Martha. "But when I got up, only the victims were bleeding, then dead. I didn't see him aim for anyone else. I was under the table, so I couldn't see his gun."

Something didn't click with Lucias. He kept focusing on it, but continued with his work to make sure things went smoothly.
"So, to summarize, you said that a.) You brought the food while they were arguing, b.) hid under the table when Al shot his wife, and c.) Managed to evade detection long enough for him to kill off his family. Is this correct?"

"You claim that there has never been a shooting in your restaurant, but I say the way you reacted, ducking under the table, not even being scared that you might have been detected, is not the way someone who never had been in a situation like that would not have done."

His demeanor seemed to become steely. "This is a courtroom of facts and evidence, Miss Fey. Not 'shoulda-coulda-woulda'. Facts."

"Sustained." The Judge said. "I'd duck behind the desk during a bank robbery, but Mr. Mercad is right, we won't get anywhere by said what could of/would of/should of been done. Please change your line of questioning to something more productive."

"Yes I did." Bill told Martha. "The food was very hot. I received a first-degree burn from that, but had to take care of the disputing family, so I couldn't treat myself immediately. You know how it is for a waiter, don't you?" Bill asked.

"Right here." Bill pointed to the upper region of his chest. "In my work clothes, this area is not covered by the apron, so I didn't have as much protection as I would of if the defendant had pushed the food straight towards me." Bill pointed to his sternum to clarify his statement.

"I waited 5 minutes to see if he would fire again. He did not, so I made my way to the kitchen to treat my burn." Bill told Martha. "I stayed in there until the police showed up."

"Hm...Okay," Martha said. "Could you add that to your testimony? It explains why he didn't shoot other witnesses, after all." She thought about what to do next. Something was wrong and she knew it. The problem was pin-pointing what it was and proving it to the court.

"...Look, if nothing ever was added to testimonies, then most defense attorneys wouldn't be able to do their jobs well," Martha said. She knew with the prosecutor there, she would have a hard time tricking the witness like she normally would. "You said something interesting earlier. You said, "Anyone as mad as he wouldn't think to check places like that," referring to under the table. You also claim there has never been a shooting in your restaurant. Correct?"

"He was obviously new to this, and the fact that this type of incident has never happened here, so the staff didn't know what to do. Even if we did, I didn't think I was in a position to do so. Had I gone out the instant he stopped shooting, he may have shot me because he saw me."

"Why don't you just amend your testimony a little so we may get on with things. And Miss Attorney," Lucias said. "don't forget that opinions and 'ifs' won't win a case. Remember, evidence is everything."

A loud crack could be heard as Lucias bit clean through his lollipop.
"Witness! This is a sacred court of law-- when you are asked to do something, you must do it. If we ask you to alter your original testimony to include these details, then you had damn well better do just that."

Lucias rarely got angry, but this man's attitude and swagger had put him on edge. If anything, he just wanted to get this man off the stand before losing his cool and actively assaulting him, but for now, it was Lucias's goal to get things moving again.

"...okay. So, you said nothing else new, correct? Then does that mean that the defendant running out of ammo after he fired his shots was evident?" Lucias said with an evil grin. He was walking the line, considering how much of a big clue to the Defense this could lead to, but if it got this impudent man to stuff his pride, then so be it.

"YOU IDIOT!" Bill yelled. "I MADE THAT GUESS DURING THE INCIDENT, NOT NOW!" Bill growled, shaking his fist in fury.

Don was having silent laughing fits.

"AND I ALREADY TOLD THE COURT THAT I GUESSED IT WAS SAFE FOR ME TO GO TO THE KITCHEN!" Bill exhaled sharply. "Can't you two attorneys get any stupider?!" Bill asked.

"Mr. Palochini, I understand that you are frustrated, but insulting the attorneys won't get us anywhere and will result in even more fury." The Judge told Bill. "Take a deep breath, then answer the prosecutor's questions." He instructed.

Bill took a deep breath, then waited for a question.
