As of the moment you speak, it becomes fair game for Miss Attorney over there to poke and prod, regardless of how small YOU think it is, and regardless of how small it REALLY is." Lucias was calm again. "It's not my place to question witnesses, though. Only to help the proceedings run smoothly and to ultimately prove the defendant guilty."

Although he was still smiling, his eyes shown with a sinister glint as he looked Bill straight in the eyes . "Now, will you be so kind as to let the proceedings run smoothly, Bill?"

"I've been doing that this entire trial! It's your guys that are asking pointless questions!" Bill said.

The Judge shook his head. "If there are pointless questions, it's a part of my job to make sure the question is changed to something more relevant, or just simply make sure it doesn't get answered."

"Mr. Palochini, this guess of yours is all this court has to go off of," Martha said. "If he still had ammo, then that means this crime had more meaning than a man angrily killing his wife and killing his kids because they were witnesses. Isn't that important enough for you to grasp? And another thing...You hid under the table. By that, do you mean my client's table?"

"Of course I was!" Bill told Martha, clearly irritated by the proceedings. "If I was at any other table, there's a good chance he could of SHOT ME!" Bill yelled. "Your Honor, I've made it clear that I guessed several times already, yet the defense obviously hasn't been in a fight-or-flight situation before. Can you instruct her to change her line of questioning? It's getting on my nerves, and it's getting nowhere. Besides, it's already been done, there's no changing that."

The Judge nodded. "Ms. Fey, he did indeed make that point clear. Unless you still have a problem with that idea and can prove it to be wrong, please change your line of questioning." The Judge instructed Martha.

"...I apologize, Mr. Palochini," Martha said, sighing due to frustration. She had no evidence besides what little she managed to weasel out of the witness beforehand. There was something odd about the whole incident all together, which she knew all too well, but couldn't prove yet. Not until she could make the witness slip up somehow.
"Anyway, you hid under the table. How many shots did you hear while you were hiding?"

"6." Bill told Martha. "Guns usually have 8 bullets a round. With that in mind, I couldn't burst out immediately. I figured 5 minutes was a long enough wait."

"Then I'm afraid there is a contradiction!" Martha shouted. "He shot his wife in the head. That required one shot. That is the one you saw. Then, you ducked under the table. You claim to have heard six shots from when you were lying down. Only five more shots were fired that night, according to the detective and autopsy report. Therefore, you heard one extra gunshot!"

"That's why I asked you for how many you heard while you were hiding," Martha said. "And you said, "Yes, did you not hear me the first time?" Now that there's a contradiction, you change your mind. "I heard a total of six bullets that night" is very different from, "I heard six bullets while I was hiding." Which one of these two is the truth?"

He had wondered how long it would take the Defense attorney there to figure out the slight error in numbers. However, the way that Martha phrased that last part made him wonder... how far would she really go for the win.

"Martha, while I am enthused that you at least have some skills to back up your badge, I can't say that there is much of a difference between 'that night' and 'while I was hiding', when one falls into the other easily. After all, 'that night' was when he was hiding. Also, just for some fun, I would also like to point out something. Take a look at the autopsy report again. Specifically, right here:"

Why not be so kind as to fill in the blank as to who is the only person who COULD have had an extra bullet hit them without it contributing to the cause of death, yourself, Miss Attorney?"

Martha paused for a second, afraid her nerves would make her say something stupid yet again. She took a deep breath before speaking. He was giving her a major clue as to what to do.
"The only victim that could have had that happen would be the wife," Martha replied to the first question. "But that means someone left something out of the report that guaranteed everything was there."

Lucias snapped his fingers.
"Incorrect, unless you have some crazy idea of her being shot before she even got to the restaurant. Remember, according to the reports, he shot the wife once-- this being supported by witnesses (some of whom have abstained, much to my regret, from coming to the stand) who at least supplied an account. Remember, the wife was shot in the head with a single round. BOOM, and dead. We figured this out earlier, yeah, that she was closest to him, correct?"

Taking a drink of water, and then returning his new sucker to his mouth (the miracles of his briefcase-stash of candy knows no limits), he continued. "Assuming that all the numbers are correct, then what we have is a slight clerical error. I did the liberty of actually pointing out whom the only victim was that could have sustained a 'magic bullet'-- bullet wound, anyways. If you would like a hint, remember the part that I did NOT point out just a moment ago... put that together with all that we have agreed on, and I think you can see exactly how this fits in, yes?"

"Oh, I see. You're saying it took more than one shot to kill the daughter," Martha said. "Therefore making six shots instead of five total, correct? Which still leaves one more shot that this witness has heard." Plus, I had already assumed there was a clerical error that occurred on that part, Martha thought.

"I believe that we are a bit mixed up, it seems."Lucias said with a sigh and a shake of the head. "As far as I can tell, it would seem that this issue stems from the six bullets and probably my phrasings of the facts-- by magic bullet, I meant to say that there was a sixth shot not added to the record, at least, not in good detail. A matter of opinion and interpretation, really..."

Pausing to think, he decided on a good way to straighten the facts. "Your honor, I would like to propose that we have a quick summary of the determined events. If you would permit, I would like Miss Fey to act as the recounted, to piece the crime together and explain this witness's location in the events, for the sake of understanding what has easily occurred. Of course, myself ad the witness here will have to help her, correcting mistakes and all that. This way, we all may better understand where we are in this case as a whole, rather than all four of us being on a different planet. Agreed, Your Honor? Martha?"

Asuka snapped out of her nap... She had worked for 48 hours straight... Her boss told her to do something... Important... She couldn't remember what... Erase old things... But that wasn't important... Right? Yeah, it was probably nothing. Asuka asked a nearby man what had happened so far. He seemed a bit angry for her tearing him away from the trial. He gave a quick recap and turned his attention back to the trial...

"Wow...that's a lot... Dang. So he even cried and this new witness is a total ass... Cool. "

"According to the witness's testimony..." Martha began. Where was that prosecutor going with this? But there had to be a point. Maybe, if she repeated the testimony...She felt herself weakening for some reason. Suddenly, her throat was dry. "May I...have a glass of water?" she croaked. Damn! Fine time to get sick! Get a grip!

"Oh, sorry..." Martha mumbled hoarsely. How did I miss that? And why don't I want to shove that 'dumbass' down his throat? Hm...Usually I play stupid as a strategy, but this time...Ugh! What am I even supposed to be doing right now? She grabbed the glass of water and drank fervently. Focus. A guy's life is on the line. If you quit now, you'll essentially give that man a death sentence. You don't want that, do you? Martha noticed that she felt no relief from the water, and the courtroom was spinning.
"Your Honor," she croaked. "Please allow the defense a..." Shit! What's the word I'm looking for?! "A r-recess?"

((Woot- this looks insane. Is there room for a Lawyer or Detective in this RP? I have a character that could cover either role based on his background. It'd be great to shove him in court :godot: I think he'd like a chaotic law system that was like a game show :gant: ))

((I originally intended to have multiple cases/investigations to occur at the same time, so when you see it fit, you can make your entrance into this case, or you could introduce yourself, then start a case. I recommend the former)).

"Sure," The Judge told Martha. He started to reach around for something under the desk and handed it to the bailiff, who in turn handed it to Martha. "Those coughdrops might come in handy." The Judge told Martha. "Court is adjourned for a 15-minute recess."

(( Is this whole thread one case? I'd like to read the whole RP for this whole court case before I start jumping in. If I'm going to leap into this current case, it's probably easiest that I take the hat of detective investigating the scene just to keep things simple as we have a lawyer already. Could you please tell me what page this case starts from? I'll read from there. Till then, I'll do a small write up of my character.

Name:- Zeth Gant
Age:- 27 (I assume this is based around the Phoenix Wright era?)
Nationality- American
Details- Zeth studied as both a Lawyer and Forensics, and is very good at both. He has a strong passion for gambling, and has no issues with manipulation of any sort. As a lawyer, he takes alot of chances in court, and has been known to force guilty verdicts on innocent clients that are involved with dark crimes outside of the case he defends them for. As a detective, he sometimes manipulates the scenery to achieve the same result. He however only does this to criminals he feels SHOULDN'T get a Not guilty verdict. He's essentially a vigilante.

Lucias decided to take the recess to refresh himself while awaiting Martha's review of the case so far. He had nothing to lose by waiting, and everything to gain once she stated something as fact-- assuming he didn't have to correct her on it. She'd agreed to the terms, so to him, it was already set in stone.

He found himself rather parched once he reached the Prosecutor's lounge, and so went to find a quick drink of water.

Zeth Gant, who had been sitting in the front row of the audience, as close to the action as he could get leaned back in his car, tweaking the end of his hair nonchalantly. He had spent a while considering the facts of the case before him, sketching down notes and diagrams in his book. Watching court cases for him was fun- like playing Cluedo, but with the added bonus of having 3D pieces to manipulate with.

Another recess... Zeth thought sadly, watching Ms Fey leave with a slightly strained look about her, The defendant refusing to talk is putting alot of strain on her. She looks like she needs to adopt a bad habit of some sorts to make it all better.

So... what do we have here... 7.30, the defendant's family order their meal, and between then and 8.10, they waited for their meal, and got into an argument. At 8.10, the waiter comes up to the table and sees the argument, just before the defendant pulls out a gun and shoots it. I assume that the defendant had fingerprints on the gun, or had means of cleaning the gun afterwards. I wonder who the gun was registered to... In anycase, the defendant shoots his wife in the head... WHERE in the head? Did they show where the bullet was shot from? In any case, that was close range which makes sense...

Next, the waiter is pushed over, and the dinner is spilt over his chest- he has the burn marks to prove that, and amongst the panic, he drops to the ground and hides under the table. That's pretty odd, cause unless that was a 3 or 4 legged table, there wouldn't be much room to hide under there with two grown adults hanging their legs there... What DID the tables look like? Maybe they were big enough...

Ok, then there was 5 more bullets shot. And it seems he was sitting as he fired all 5 of them. Three into the boy and 2 into the girl. The boy didn't get a chance when 3 bullets hit him. Over kill there having 3 bullets I would've thought, but apparently the guy wasn't thinking straight. In the mean time, our young daughter managed to hike up over the brother to run off. That makes NO sense. OF all the people that'd go under the table, I'd say SHE would cause she's small. She'd then raise attention to the waiter. That testimony sounds b/s. To make it worse, they fired the damn bullet at her in her mouth while it was open. Then there's the 'magical' bullet that noone has found yet. The autopsy is trash. How can they hide the second bullet in her? Are they trying to say she took two bullets through her mouth? Where is the second entry wound? What a trite investigation... I wish they'd find out where this last bullet is.


Glancing around the place, Zeth watched Don pace about nervously as the down time ticked by. He seems pretty wound up by all of this? I wonder if he could have some sort of injury in this case that might be of relevance? Watching Don's movements intensely for a moment, Zeth checked to see if he seemed to be un comfortable in any way.

"So, it's definite that the waiter burned himself," Zeth murmered, "6 bullets were shot and 5 were clearly reported, where everyone is sitting is correct, and if the defendant is anything to go by, there's a smell of framing in the air. That's all really. Not alot to go on. If only we knew that the defendant touched the gun definitely, where the daughter wandered off to, cause that's all here-say at the moment, and where that 6th bullet got too we'd be somewhere... Most importantly though- what does the defendant have to hide about that argument he supposedly had? If he IS innocent, what is stopping him from talking?"

((Can someone tell me if Don seems injured? :D ))

((Stabbing in the dark a bit here. A few thing seem to be missing. The court record makes all this easier in the game... no back tracking of evidence. SO much conversation to filter through T.T Have I got it right so far though?))

Martha sat on the couch in the defense lobby and took some cough drops. She felt her throat clearing up. All I have to do is finish this case, then I can see a doctor... she thought. She stood up again, only to get dizzy like she was before. Don't give up now! This is the precious time you needed to talk to Al. But instead of talking to Al like she planned, she ran to the bathroom, where she stayed for almost the whole recess.
