The judge nodded. "Mr. Mercad, you wanted to review what the court knows about the murder, correct?" The judge asked Lucias.

Martha stared straight ahead. "What finger?" she asked meekly. "I can't see...Oh..." She got even paler and her eyes rolled to the back of her head. The heart monitor showed her heart was no longer beating. ((I feel sorry for that poor nurse.))

"HEY! MARTHA!" The nurse saw the heart monitor, then checked to see if Martha was breathing. He then pushed the emergency button by Martha's bed, summoning doctors and other nurses to the room. Another nurse prepared the defibrillator as the doctor oversaw what was going on. He waited until the nurses were done to check Martha's condition.

"Charging...Clear," a nurse said, zapping Martha with the defibrillator.
"Beep beep booooooooooooo..." the heart monitor went.
"Charging...Clear," he repeated, zapping again. Still, the heartbeat didn't last. The nurse shook his head. "Charging...Clear."
"Beep beep beep beep boooooooo..."
"Looks like she's..." he began to say to the doctor.
"Ugh..." Martha interrupted. Her heart seemed to be barely working. "Are you done shocking me now?" Some of the nurses and doctors laughed uneasily. She then turned her head to the doctor (the one overseeing everything). "What's wrong with me? Why did I suddenly...?" she asked.

".... Go into cardiac arrest?" The doctor asked, trying to complete Martha's question. "It might have something to do with the poison. I'm going to have to draw some blood to try to get a sample of the poison from you blood. I take it you don't have any problems with this?" The doctor asked.

"No. Do whatever you need to do, Doc," Martha replied, offering her arm to him. "But what kind of poison would do something like this? And why is this happening again? I thought...In a hospital, I wouldn't be poisoned so I'd get better..."

((It was his idea, but at the same time, he was working with Martha, not Zeth, so maybe he'll change his mind on the review)).

"You drank the potentially poisoned water not too long ago, right?" The doctor asked. "1-2 hours ago? Does that sound right to you? Because you may have reabsorbed the poison in your large intestine, which might explain why you experienced the cardiac arrest. Your heart was just fine before, right?"

"According to the heart monitor, it was," Martha replied. "And, yes, only a couple hours ago if that. Oh...What kind of poison would cause all this? I mean...I'm not likely to go into cardiac arrest again or...Die because of this poison now, right? Unless I ingest more, which I doubt will happen."

"A specially designed one, probably something created by some organization or something." The doctor said, as he prepared to draw blood from Martha. "It's clearly one designed to work by water absorption." The doctor put the needle in the artery, then pulled the plunger back, extracting Martha's blood.

Martha winced, but didn't pull away.
"Ah, the needle. My little friend," Martha said. "So, that means whoever did this probably couldn't have just made it by themselves...Huh..." Only I can't prove who did this...Even though I have my suspicions. Guess I'll just have to wait. Get out of here as soon as I can.

((Sorry, I sorta had been putting this off-- this sorta feels like a chore rather than a game to me now. ^^;
If I am gonna do a recap, I'll need to reread all of this case-- it's been months since we stopped originally, so I can't remember much of the finer details, as well as most of the tricks Lucias had up his sleeve originally.))

"Yes, your honor" Lucias said, speaking slowly. "I had originally intended for the Defense to speak the events, and for me to approve of the instances and sort out fact from opinion... but as you can see, we are now in need of a recap for a completely different reason."

He gave the new Defense attorney an uneasy look. 'I have no idea who this guy is, or what relation he may have to this prior... I just hope Martha is okay.'

((You're right- it is a big task ^^; I'm not sure what your techniques were- I'd have to look them up myself, but I think I attempted a recap a few pages back. I'll look back at this tonight and see how much we can recall out of character. It's good to know we have a prosecutor again though :) ))

Spoiler: Autopsy Report
Defendant: Al Machino
Crime: Homocide
Victim(s): Mary Machino (wife), Jill Machino (daughter), Scott Machino (son)
Time of death: 8:10 PM, March 12, 2060
Murder weapon: Handgun
Cause of death: Bullet wound to the head, brain (Mary), 3 bullets to the chest, causing fatal damage to the lungs and heart (Scott), bullet traveled through throat, damaging spinal cord in motion (Jill)
Motive: Al had an argument with his wife (Mary) in Danny's Restaurant, which escalated into violence, causing the defendant to use his gun on his wife. Since his children witnessed the act, he had to kill them as well


Danny Palochini
owns the restaurant and witnessed the murder... Hang on... This turns into Don owning it later T.T

Fernando Palochini was the detective. Some info from him "The mother was leaning her back against the wall behind her seat, meaning that the suspect shot her from the other side of the table. The kids ran for help, but started in a way that allowed him to shoot their anterior (front)areas." They were sitting at a corner table. There was 6 bullets. No fingerprints on gun, as if it were wiped clean. No one saw him actually shot his wife, but everyone saw that he pointed his gun at her. And because they were still looking in that direction, they saw him shot his kids." "He shot his son first, in the chest, like the autopsy report said. It was an easy shot. The daughter, despite being cornered, crawled over his head brother, so she could try to escape, but the defendant shot her while she was trying to climb over her brother." I estimated that the time of death was around 8:10 PM... Police got the call within the minute of his death.. It took me 15 minutes to get there..... No wait, police called me after they calmed everyone down at 8:25, when they arrived.... It took me 15 minutes to arrive as well, so that would mean that I arrived at 8:40 PM." Don called the cops apparently- this cheesed off Don.

said- "your saying that: a) When Al started shooting, the people in the place panicked, and blindly fled; and b.) the chefs also fled, leaving their meals in mid-preparation, yes?" also "The majority of the restaurant patrons also refused to testify today, because, while only a few saw the actual shooting, the rest did not actually see it, either completely or directly, according to what they (the patrons interviewed, Martha) were willing to give us."

Al used his right to remain silent *sigh* He was watching Martha's trial that ended at 7.30pm

Bill Palochini was the waiter that witnessed murder. He said- "I remember the incident as clear as day. I still feel the burn from when I was pushed back, causing me to smash a plate of hot food toward myself. What a mess it was." "I took the family's order around 7:30, then gave them some water 10 minutes later. The next 20 minutes were spent cooking. Went I went to serve there food, the defendant yelled at his wife (which caused me to jump, dropping a few plates on the ground, one "nice warm" stake on my shirt), then shot his wife and kids." Bill told Lucias. "As soon as he fired the first shot, I immediately ducked." He saw the shooting at 8 (Oh f@#$- contradiction. They died at 8.10pm XD No wonder Don freaked) "As the family's waiter, I tried to break up the argument." Bill told Martha. "But they wouldn't stop arguing. Suddenly, the defendant pulled out his gun and shot his wife first. That's when I ducked." (under the table). He recieved first degree burns from dropping the meal on his chest area where the apron didn't protect him. Oh- and this is interesting- "He was angry. Haven't you been angry before?" Bill asked. "I have. Let's see what happens when you're carrying hot food when you hear that your car gets jacked. You understand what I'm getting at?" This is interesting he knows this- "6." Bill told Martha. "Guns usually have 8 bullets a round. With that in mind, I couldn't burst out immediately. I figured 5 minutes was a long enough wait."

Then they determine that there was 6 shots fired- 1 went into the wife, 3 into the son, and atleast 1 into the daughter. 6 shots were also RECOVERED. Where did the last shot go? and how come they have it?

Crossing his arm over, and pushing his glasses back up his nose coyly at the question, Zeth thought about the case some. There was quite a few directions that were opened up that he could take, but he still wasn't certain which one was the correct one. Alot of the questioning for the case had been arguing which fuzzed over ALOT of the points that he kind of wish were tabled, but weren't. He'd have to bring up a bit of dirty laundry to have some potentially crucial information resurfaced. It'd be difficult. He didn't even get the luxury of a proper questioning from Al before he started. The poor guy was too damn upset to be of any use to him. It was understandable... Zeth guessed. He didn't have family of his own to dote over anymore, but he understood the pain of loss.

"The tone of the trial has been set, your honour," Zeth started, shifting his left arm to his waist, before extending his right arm out to Lucian, and forming it into a finger gun and pointing it at the prosecution, "Murder of the second degree? Or a game of 'Who Framed Roger Rabbit?'" 'Shooting' his 'gun' at Lucian with a wild grin, Zeth's eyes glowed in interest, "You, my lolly popping pal, have taken the reins of this court case long enough. I think it's time for a recap on the Machino saga. First, I would like to ask a few questions." Turning to the judge with an interested look, Zeth placed his hands on his waist, "Is it confirmed that all of Mr Machino's family passed away at 8.10pm from a various array of bullet wounds? Has Detective Palochini labelled where each of the bullets were extracted from? And do we have any photos from the crime scene?" Giving the judge a grin, Zeth gave him a confident grin, "If someone can clear that up for me we can get started on this crazy show!"

Don's cringed as Zeth asked those questions, yet the judge wasn't surprised. "It is not the detective's job to label where the bullets were extracted from." The judge said. "The autopsy confirmed that the family was killed at 8:10pm by bullet wounds from a handgun. It found 5 bullets from the bodies, however, it never said what kind of handgun was used. Mr. Palochini, the waiter, said that guns usually have 8 bullets, but for all we know, the gun that was used was only capable of holding only 6 bullets. Critical witnesses have chosen to remain silent about this case, but the way things are looking so far, it seems to me that the defendant is guilty. We still need to figure out what happened to the 6th bullet, however. Also, there are some other facts we still need to confirm."

"They never specified what kind of handgun was used? Well then our murder weapon could be conjure. Any gun could fire those bullets and point the blame at our so called murder weapon without the ballistic fingerprint." Lifting his arms up and crossing them, Zeth tapped his arm judgementally, "I think it's pretty important to update the information on the relationship between our gun and bullets, cause if they don't match, up then that blows this case right open, doesn't it?"

The judge shook his head. "The bullets retrieved from the autopsy came from the handgun, which is only capable of holding 6 bullets." The judge said. "You may want to examine the handgun for yourself before you continue conjecturing about anything related to it."

Martha waited for the doctor to finish testing rather impatiently. She wanted to know what was causing all her problems already and get cured so she could get back to court. To try to explain to the new defense attorney that she had no desire to take the case back over, but that she could be a key witness. Even walking out the hospital doors without falling over would be a step in the right direction. She tried to focus on Law and Order, but she was too busy instead focusing on what she would say.

"My mistake, your honour," Zeth shrugged with a big grin, "It's just that if you have 5 bullets that were shot from an unspecified hand gun, then that to me doesn't necessarily mean that it was the first weapon you find at the scene of the crime. Just like if you see a man with blood on his hands, that it doesn't mean he must be a murderer. This is all meaningless talk however if it has been proven to have come from the handgun in question."

"But now you mention it," Zeth started, stroking his goatee thoughtfully, "I would like to take a look at the gun, and it's documentation for a minute."

((Zeth is going to be looking for things like if the gun was held correctly, or if the gunman is left handed based on the prints on the gun. Obviously the chambers and magazine thing. Obviously the magazine would be empty? What caliber is the gun (ie do they need to be trained to use it? Special issue? Who is its registered owner?), weird misc things that may be applicable?))

A nurse came into the room with something in her hand. She walked over to the trash can and threw what she had away. The nurse looks familiar for some reason.

The bailiff brought the gun to Zeth. "That gun was the one found at the crime scene. I think the autopsy report is clear enough at this point." The judge told Zeth.

Multiple fingerprints were found on the gun. It's clear that the gun was handled by at least two other people because fingerprints from both hands are on the gun in a position that indicates use. Furthermore, those two evident sets of fingerprints indicated that neither of the gun's users used both hands when firing the gun. The other fingerprints indicate that the gun has been handled by multiple people. Oddly enough, the gun was registered to Al. The gun looks modern, yet it only has room for 6 bullets. The autopsy reported 5 bullets found from the victims, yet there were 5 bullets in the magazine. It can be concluded that the gun was recently reloaded. It can be assumed that this gun was obtained illegally. The registration engraved in the bottom part of the handle, looks questionable, and contradicts the documentation that the court provided. The gun itself looks like it was supposed to be a .35 caliber gun, but when measured, it can be found that it's a .40 caliber gun.

"Hm? Hello, Miss," Martha said casually to the familiar nurse. Why had she seemed so familiar to her? She felt like she should know this nurse, but she didn't. And what was she throwing out? Probably just a needle or something. It's probably not relevant.

((Uh- you've worded it a little bizarrely, but I'll try my best to translate how I think you're trying to say it ^^; ))

Putting on some latex gloves he had in his pocket, and snapping them back dramatically before looking at the gun, Zeth went into forensics mode as he checked over the gun. He wasn't a ballistics expert, but maybe there was something he might spot that was over looked?

"Your honour," Zeth started after having a look at the gun, "It seems our gun has acquired an identity crisis since it's final moment of glory." Taking his glasses off to double check the serial number, Zeth acquired a knowing pose, "See, your report, which I believe belongs to this case, calls this gun one name, while the gun thinks it's another. It also seems to have shrunk in caliber over night from a .40 to .35 caliber."

"Furthermore," Zeth continued, looking down the barrel of the gun with the magazine removed, "Had it been this gun used in our crime, then your detective have an odd interpretation of a joke by reloading the magazine with 5 bullets. An odd thing to do when the autopsy states that the whole magazine was off loaded into the family."

"Lastly, we have the REALLY interesting part of this evidence," Zeth grinned, placing the gun back into its bag carefully, snapping his gloves off his fingers and placing it on the table beside him. Holding up his right hand and forming it into the shape of a gun, Zeth used his other hand to ‘grip’ the gun, pointing it at the prosecutor, and ‘shooting’ him with it. “This gun may have been owned by the defendant, but his isn’t the only set of fingerprints on it. I’d like to hear your opinion on these matters Mr Meracad? Cause frankly, 2 and 2 aren’t equaling 4 just yet.”

((This is no doubt a terrible time to do this, but I cannot wait any longer, circumstances pending.

I would hereby like to withdraw from this RP. My character is up for grabs by anybody who wants to use him, provided they keep him as in-character as they can from what has been provided.

In all honesty, when this game suddenly came back from the grave, I was slightly horrified; I remembered nothing about the story, nor had any of the interest that I had once shown with zeal. As of now, I also have personal matters (read as: homework) that takes precedence over the RPs. So as to continue in the RPs that I have dedicated myself and show true zeal for, as well as not overload myself or continue to dread every time this thread updates, I hereby leave this game.

Sorry if I ruined anything, guys, but... I really, really cannot stand this RP anymore. When it died, I accepted that, and do not like how it returned. It feels like some form of responsibility that I did not ask for, that was shoved onto my plate after the meal had ended and I had my share.

Like I said, my character, Lucias Meracad, is up for grabs. Try to keep him as personality-wise the same as you can.
It was fun, if not only in the beginning...

(( T.T I had a feeling this would happen... I guess it couldn't be helped though :( Oh well, thank you for advising us of your withdrawl. I'd rather know that you've lost the spark than hope that it has returned and wait. Someperson- you feeling the same? Or do we want to make a completely new jury by outing Lucias? Rather ironic ^^; ))

((It's disappointing, but I can understand why. Though I'm not sure if anyone wants to control him, I don't want to deal with controlling a character from a former player. Don reached into his pocket, feeling around for the bottom of his gun's handle, only to feel that the engraved ID had more info than he remembered. He slipped his gun out, just to take a peek at his gun, only to notice that it was the one assigned to Al. Don was shocked, but smoothly put his gun away. He tried to hide his shock.

Noticing Don's brief moment of shock out of the corner of his eye, Zeth tried to keep his eyes fixed on the prosecutor as he kept that info in the back of his mind. Don was sweating about something he said, but he couldn't prove anything just yet. Not untill the court acknowledged that Don needed to be searched. He wasn't a suspect yet, and to pull him out on a whim was just guessing right now.

"Baliff, I think I'm done with this evidence for now, could you uplease pass this on to the Prosecutor for inspection also? And one more thing..." Motioning the baliff closer, Zeth pulled his microphone off for a moment ((I assume they'd have one since it's a TV production, waiting for the bailiff to come closer. When the baliff was in whispering distance, Zeth drew closer, "Please ask the security to keep a close eye on Don Palochini. I have a feeling that he has something on his possession that the court may require, but I can't prove it yet. He may try to dispose of it. Please make sure that the security don't make themselves too obvious though. He's been acting funny throughout the whole trial and is very conscious of his well being."

((Zeth would proceed to tell the baliff who and where he is without pointing or lookign at Don))

When he was finished talking and the bailiff walked off, Zeth re connected his mike to his lapel, and grinned.

The nurse's eyes widened, then relaxed. "You don't know me from anywhere." She told her. "Why do you ask?"

What was that one thing?! Don asked himself. He tapped the shoulder of the guy sitting in front of him, whom looked a bit like Don (but not too much). When the guy in front of him turned back, Don whispered "Figure out what the defense told the bailiff, then do something about it." Don couldn't bring up their mistake. Not where he was sitting, not in a televised court of Law. The man got up, then left the room.

The bailiff brought the gun over to the prosecutor's desk.

Her eyes widened...Was she...Lying just now? No, she's probably just a little freaked out that someone who's never met her thinks they know her. That's perfectly natural...Right?
"Really?" Martha asked skeptically. "You just look so...Familiar." She tried to place where she's seen the nurse, but it wasn't working. Her memory hadn't exactly been great since being in the hospital, though...
