Don wasn't phrased by the judge's demand. In fact, he seem confident.

"So much for the easy stuff," Zeth grinned, giving a shrug, "So I'll cut straight to the chase and get right to the point of why you were called up here in the first place. Your gun was at the scene of a triple homicide, Don Palochini so it's in YOUR best interests to not ignore this fact and start giving us some answers. I want to know about that gun. I want you to testify to this court when you last saw your gun, where it was, and how it was kept.

"That's what I'm trying to prove!" Don yelled. "I already said that I left it on the desk, and have suggested that the detective might have planted it there."

"However, that's merely conjecture." The Judge pointed out. "While it's only a possibility, it seems like that's the best answer we can get from the witness." The Judge said to Zeth. "Unless you actually have some more questions to ask."

Zeth face palmed.

"Is the door to your office even LOCKED? You're in a restaurant! Do you have even ONE ounce of security in your WHOLE restaurant? Do you leave your sensitive documents on the table free for the looking?" Pausing for a moment, Zeth glanced aside. His insinuated incompetence was outstanding, "Or maybe you atleast leave a lock and key on the door so atleast you have SOME peace of mind on your office door."

"Mr. Gant!" The Judge yelled, starting to get irritated by this whole trial. "The witness testified that, at some point that night, his office was searched by the detective. As far as we are concerned, that is a true statement. What is conjecture, however, is the fact that the detective may or may not have taken his gun from his desk. Based on that, what do you expect to achieve by bringing up the restaurant's security, or the lack thereof, when the police was at the restaurant to investigate the murder?" The Judge asked, impatiently.

"I ask this, because if it were locked, then only someone with authority could get it, your honor." Zeth replied simply, "It is a BIG assumption that only the detective could've taken that gun. If it wasn't locked then ANYONE could've walked in there and taken the gun. I mean, I wouldn't have a clue where his office is. For all I know, it could be in full view of his restaurant. Did we get finger prints off his door handle?"

Biting his lip, he knew that if the door wasn't locked, it looked bad for Al, but if it WAS locked, it was at least SOMETHING in this trial because Don sure as heck didn't provide any usefull information.

"If there was probable cause, the detective, being a state official, has the capacity to enter the initially locked office, if there was probable cause. The witness was unaware of probable cause, and frankly, I wouldn't be surprise if the detective abused his capacity to go in and take the witness's gun. But I only suggest that because he tried to tamper with the court's evidence on the spot. But if he didn't, who else, with no authority nor ownership, had the opportunity to sneak past the investigators, the restaurant staff, and the owner, who was present the night of the murder, into the witness's office, and take his gun?

As for the fingerprints, he is not the only person who has a reason to be in the office. Chances are that a) there might be too many fingerprints on the door handle, or b) the cleaning staff might have cleaned off the fingerprints, assuming that the state had no reason to bother the restaurant, seeing as the investigation was completed. Mr. Mercad, I order you, as a part of your phone calls, to call the restaurant's cleaning staff to determine whether or not the door handle has been cleaned, and if so, when it was last cleaned. If it has been cleaned before the murder, then the court will send a forensics team to retrieve the fingerprints. Elsewise, it is none of our concern. Either way, I am penalizing Mr. Gant for this irrelevant line of questioning with neglect of possibility."

The Judge made the penalization final with a bang from his gavel. "This case was poorly investigated." The Judge mumbled, as the audience began to grumble, though the Judge did not silence them. The Judge sighed, then rubbed his eyes.

((SP- This is starting to get irritating cause if it's not the Don telling me I can't get evidence, it's the JUDGE telling me I can't ask for it. I can't have a layout, a sketch of the area, video tapes, can't know if there is a lock on the door, I can't even ask if it was possible the gun was taken BEFORE the investigation. You may want me further along than this, but Zeth doesn't have ANYTHING to go on cause right now, NONE of the evidence he has right now should be valid cause the detective is obviously a crank. Shouldn't the judge be ENCOURAGING the lawyer to pursue avenues right now? Cause right now, I'm pretty certain he's on Don's side cause I can't even get BASIC info off him. Like if the door has lock on it. ))

((To be frank, this RP is not fun for me at the moment cause of this. :larry: ))

((If you want me to take a different lead, then give me atleast SOMETHING I've asked for here. I'll happily move on. Can I atleast get an unofficial diagram of where Don 'thinks' his office is? Or if there's some sort of security on it. I know NOTHING about this office except that it exists somewhere. Probably not at the restaurant but I can't get any evidence right now so... :sadshoe: I'd like this to be a challenge, but right now if I'm getting blacked by EVERYthing I ask then that sucks.))

"Eh, screw it, I'm giving the witness his 24 hours! Looks like the jury is also getting restless. If any one of you has any objections, voice them to the clerk, who will accommodate your objections through appropriate action. We will resume tomorrow!" The Judge banged his gavel, then everyone started filing out.

((There was a reason why the investigation was poorly done. You may want to take the time to investigate properly. You may have to team up with the prosecutor for this one)).

"W-wait..." It was too late. The judge slammed his gavel. And now she had no way of protecting herself or Al. Then, Martha smiled softly.
"Well, Mr. Gant, if we have 24 hours, we might as well make the most of it. Where would you like to go?" If Al was killed, then the trial wouldn't be able to continue. If Martha was killed, then...Well, then what? The case would go on like a normal case. But at least she would make sure she contributed to bringing justice to the ones who killed Al's family first, she hoped.

Lucias was about to shout, "Objection!" as Zeth tried to find out about the lock, but such an action was unnecessary. The judge already said all Lucias would say.
"I understand, Your Honor," Lucias said. Once the gavel slammed, he grabbed his phone and dialed the number for the Palochini restaurant.

(( Sorry hon- I was kinda hoping he was gonna cough SOMETHING up if I asked the right question. Apparently it was meant to pan out to day two. That's cool. It's all plot. ))

Zeth grabbed his hair in frustration, for a moment, before slamming his fist down onto the table.

"Your honour! Before this court adjourns, I request that all evidence collected to date is double checked for authenticity. When the murder weapon is proven to have be modified THIS much since the investigation, then that leads me to not trust the rest of the information as it stands. This must be checked, even if I must do it myself."

((Zeth is primarily a detective by character- or more accurately, he's a CLEANER. His character isn't much interested in law, as he is about evidence. If you wish to have him moved to detective, and Martha back to lawyer, then it's cool ))

"See if it's authentic?" Zeth asked, "They should do an evidence review of this whole case. I don't believe a word Fernando has said this trial, and none of it can be backed up by proven evidence. The only thing that stands as true is the times of death. We can't even guarranty the location cause they wont let us talk to anyone. I'm not appealing to just the clerk. If they don't do their job right, I am personally going to kick their..." Stopping for a moment, Zeth paused, rubbing his temples to calm what he was about to say. Calming his wound up mood, he closed his eyes for a moment.

A minute later, Zeth turned to Martha and smiled, "I'm going to make sure that tomorrow's trial is going to have some evidence that IS decisive, so we can tell if something is forged. I think we need to team up with our lollypop sucking mate to make sure all the evidence is in check."

Glancing around, Zeth spotted Lucias still packing up his notes for the case. Dashing over to him, Zeth leaned over the prosecutor's table.

"Lucias," Zeth started, "You're still serious about finding the real truth about this trial, correct?"

"Lucias, you're still serious about finding the real truth about this trial, correct?" he asked. Lucias smiled slightly. The attorney called him by first name instead of last.
"Of course I am," he said. "Why? Is there something you would like to tell me?"

Martha was confused as Zeth stopped mid-outburst and said they'd have to team up with Lucias. Well, she didn't have a problem with it, but before she would have been able to say, "no," he had dashed over to the prosecution's table. Martha walked briskly toward the desk, but decided not to say anything. Zeth could handle this.

"Because we're going to need to team up if we're going to take this mafia team out," Zeth replied to Lucias with a stern expression, "We may have another day to find new evidence to counter them, btu they also have another day to hide it, and hiding is COULD including hiding or murdering possible witnesses. Maybe even a new crime." Glancing around to Martha for a moment, he nodded to her with a smirk, "Miss Fey has been liaising with a bloke that may have the right Intel help steer us in the right direction. What do you say? Do you trust me?" Dulling his voice down, Zeth adopted a serious expression, "Cause I'm after justice. If my client HAS indeed murdered his family, then I want the murderer avenged. If he hasn't like we believe he is, then I think we have enough leverage to take them off the streets for more than just a few months."

((Um- Rosie is officially on temporary leave due to medical reasons. I don't know how long this will be SP. What do you want to do? Hold the RP till she's back and healthy again? We can't replace her. We're on day 2 of a trial that I just joined :( Seems that if she's gonna be gone a long while that we should hold it or can it :( ))

As for the RP, I'm going to give her the rest of the week to post before I do anything. After then, if she doesn't post, I'll do what we can to move on, even if it means a new trial, if you're interested. If so, the old trial will still be on hold, and storyline will progress in a manner that allows you to participate without messing with the old trial.

But no matter what happens, I hope she's ok)).

Cleaning records, floor plans...Maybe we oughta just visit the place..."

((Before I get back into RP again hon, how frequent can you update? Are you just updating cause you have a better than bad moment? Or cause the bad isn't stopping you from RPing? Cause if you're only rping cause you're having a good moment, you should wait till you're better. I don't want to wait weeks for a response, and it's not healthy for you worrying about the RP.))

((As long as you don't spend too much time online, you should be fine, but Akrillian has a point; you really shouldn't be worry about the RP too much while you're still ill)).

"We don't maintain our cleaning records." She said. "We hire a cleaning agency to clean the restaurant for us. The owner feels that it benefits the economy by doing that. Is there anything else I can help you with today, Mr. Mercad?" She asked.

(( Ah- cleaners. Zeth was originally designed to be one of those. The glory of Mafia ^^ Do all your dirty work, and get the cleaners to erase all the evidence >:) I'll wait for Rosie to respond before I continue :) Getting too deep into character and not returning for ages something I wish to do if I can avoid it. ))

He was well aware that going to investigate the cleaning agency wouldn't help; it would buy them time to cover up the evidence. But maybe it would be good to know for later.

"Let's see...." She said, as the sound of shuffling paper can be heard. "Ah-ha! We employ Prince Albert Cleaning Services to do our cleaning for us. Is there anything else I can help you with today?" She asked, as the sound of a closing door could be heard over the phone (at least the sound that doorknobs make when turned >_>).

Zeth nearly burst out into laughter as he heard the name of the cleaning company. Instead, he turned it into a cough sound, saying "Cover up!" as he covered his hand in front of his loud cough.

"Tell them to withdraw their cleaners," Zeth replied, gaining composure quickly, "I don't care if they're only cleaning their windows. That whole restaurant is potentially a crime scene. Besides..." lowering his voice, Zeth adopted a serious voice, "I think I've heard their name before. Be prepared to get a recording of that phone call. I think that I've heard that company name before. In a bad way."
