Then we need bench sprites, which means a whole new set of sprites, instead of the recolored version. So, um, it's kind of big and complicated to make a whole sheet of Diego sprites.

There are two different ways this could work:
Before the incident or doing an alternative by having him be a prosector. Those are the only explanations I can think of without having it sound stupid.
