Sounds plausible. A dumb enough jury (and juries can be dumb) could be swayed by the stronger, more influential dramatics. Chapter 1 could be simply knowing WHEN to use it.

It's full of stuff about using interruptions to your advantage, keeping the jury's attention, and treating the case like a story you're telling. I'll take some pictures of the pages and post them tomorrow.

MOVING TO A WINNING PLATEAU

EXAMPLE: A client walked into counsel's office one morning and said he was so concerned about what was happening to his marriage that there was no longer a reason to live. He said he was suddenly receiving love letters from an unknown woman, and that his wife would not believe him when he told her he was faithful.
When he went to Chicago on a business trip, there would soon be a letter arriving at his home from this woman. She knew much of his personal affairs and he knew nothing of her, or even who she might be.
Counsel asked him if he had ever jilted a woman, and he said the last woman he had anything to do with, other than his wife, was a woman he was dating at the time he met his wife, nearly forty years earlire.
"Was she unhappy about your brekaing off with her?"
"Yes, but that was forty years ago!"
"Do you have her handwriting on anything? Does she live in this area where her signature may appear on a deed at the courthouse?"
He was not sure, but agreed to find out what he could. The next day he brought counsel a snapshot of him, the woman, and another couple in swimming suits. They had been swimming at the river and had the snapshot made, and they had all signed their names on the snapshot.
Counsel gave his client a big smile and said "Let me have our handwriting expert look at this."
Within a few days, the client dropped by and was told the good news. At first, he was pleased, but then said "What difference does it make? My wife will just say "so your lawyer has hired some expert to get you off the hook." Then he stopped as he was leaving, and turned back and said "You will NEVER convince my wife."
Counsel smiled and said "You want to bet?"
Stop! Before reading further, ask yourself what you would do. How can you use this piece of evidence most effectively? How can you convince your client's wife that her husband is faithful? This is what counsel did:

"I am going to file suit against this woman for $100,000, and I am going to include your wife as a party plaintiff."
"I don't want the woman's money, I want my marriage."
"You aren't going to get any money, you are going to prove to your wife that this whole thing is a fraud perpetrated by this woman."
"How in the hell am I going to do that?"
"You just wait and see."
About a month later, counsel and the others sat around the conference room table. The court reporter was to counsel's left, his client to his right, and his client's wife sat next to him, since counsel made her a party plaintiff. Across the conference table sat this woman, and her attorney.
"Mrs. Smith, I show yu what has been marked plaintiff's exhibit 1, which is a love letter. Do you recognize this letter?"
"No."
"Is that not your handwriting?"
"No. Absolutely not."
"Let me show you what has been marked plaintiff's exhibit 2, a photograph. I would like for you to look at this photograph very closely. Take your time and make sure you read the signatures on the photograph."

She was very surprised and became very nervous. She pulled herself together and was now ready to proceed with the questioning.

"Now, Mrs. Smith, I am going to ask you whether or not this is your signature next to this photograph of the person on the left; but first, I htink it only fair to tell you that our handwriting expert is prepared to testify that the signature on the photograph and the writing on this letter are from one and the same person."

The witness looked at the photograph and then looked at the letter, and the burst into tears ad started shouting, "I'm sorry! I'm sorry!" Her attorney led her from the room.
Counsel turned to his client who sat there speechless, as his wife started crying and said "I'm sorry, dear. I should have believe you; I'm sorry."
