((This is not an official report, and therefore, not recorded)).

The gun looks the same as before, except the identification is missing. The place where the identification used to be is much more shinier than before. Upon further examination, the shiny substance is some type of plastic, which wasn't there before, yet matched the same color of the surface the identification was engraved onto. Clearly some slight-of-hand had been performed. But when?

Zeth paused at the spot with the identification, and looked at it for a moment in curiosity. Humming to himself, he started to understand what was going on.

"Suddenly, this piece of evidence became a VERY important part of this case- but not for being a murder weapon..." Zeth told himself softly, before glancing up to the detective again, "Now, detective, you've said a few times now that there is no identification code on this gun despite me insisting that there is one on the gun, correct? I just want to clarify your feelings on this identification number, but cause I have made it very clear that it was there."

"And I have made it very clear that it wasn't, and have an autopsy report to back me up." Fernando retorted. "What do you got? A bunch of legal jargon? Good luck advancing your case with legal mumbo-jumbo." He said, paying no attention to his conduct.

"Objection!" Lucias shouted. "I fear Mr. Palochini has forgotten where he is. You are in a courtroom, where there are no mere coincidences and "legal mumbo jumbo" is always used." For Pete's sake. "What exactly are you getting at with this line of questioning, Mr. Gant?"

~Martha~
Great. All alone in a hospital room with no TV. I suppose I might as well try to sleep. Not like I'll be able to now...It's fine. Al probably has a better attorney than me. He might get off today. But that doesn't mean he'll be safe...I hope whoever his new lawyer is will think of a way where Mr. Palochini doesn't die...In law school, we never had to deal with this. Martha felt herself start drifting off. We were always assuming our cases had nothing to do with the mafia. The. Freakin. Mafia! But, well...I miss those days already, and I've only been a lawyer for a couple days...

I'm not sure what he's using. I'm not familier with a plastic that can be smeared onto something and harden so it can't be flaked off without heat.))

"I'll objection you!" Fernando yelled, raising his fist at Lucias. "Unlike Mr. Gant here, I actually appreciate the importance of evidence!" Fernando was going to continue, but the Judge intervened.

((Yeah, Lucias is having a bad day with his witnesses)).

"Mr. Palochini, please calm down. The defense is on to something. Now, Mr. Gant, please continue."

Zeth looked at Fernado Palochini with a raised brow as he blew up at the Prosecutor completely.

It's ok. It's just drama. He knows that I am onto him. Zeth thought to himself with a slight smile.

"Thank you, your honour," Zeth nodded, slipping the keys to his Vespa off his belt buckle, looking back to the Detective, "Now, Detective Fernando Palochini, if you're quite finished creating an uproar, I will not only explain to you why I keep asking you to clarify yourself, but I will also show you why. You see, for the first time since this court case has opened, we have finally got our hands on a piece of concrete evidence."

Holding up the key and showing the Judge, Zeth continued, "Your honour, what I'm about to do may leave a few scratch marks on the base of this gun that weren't there before I looked at it. I apologise for that, but my reasons for doing this out weight the damage I may do. It should be documented however so that the paper trail is correct."

Bending over a little, Zeth began picking at the base of the gun, flaking areas of plastic off with the key, untill a run of 3 familiar characters embossed at the base of the gun appeared.

"Ah- that's more like it," Zeth grinned, motioning the bailiff closer, "Bailiff, could you please show this to the Judge and the prosecution please," Pointing to the area flaked off by his key, he quickly explained as much info as the bailiff needed to know to show the rest of the court, "As testified by Detective Palochini and myself, when I had that gun, the FULL identification number was showing on the base of that gun, and by the time I got the gun back, the number had been covered up." Slamming his hand down on the table, Zeth adopted a very serious tone. "Justify this falsification of evidence, Fernando Palochini. Because right now, this is looking VERY bad on you, and ALL the evidence on this case."

((BAM! Lets see him squirm out of this !! I can see a few ways. Most of them Zeth can easily retort, some not so easy. Please rememner that guards are posted near Danny Palochini incase he makes a run for it. Atleast I hope they still are?))

After the bailiff showed the gun's "newly" found identification, he then read that the gun belonged to Don.

Naturally, Don cringed at this revelation. "How'd that get there!?" He yelled, after standing out. The crowd then started to murmur. The Judge silenced them.

"This is very interesting. I'm sure that Don would like to testify now. Any further questions?" The Judge asked.

~Martha~ ((Just to change the order. xD))
Martha was about to fall asleep when she noticed a man in a black lab coat in the room. Immediately, she felt suspicious. Wait, don't doctors wear white lab coats and nurses wear scrubs? What is this guy? She felt her hand twitch. It's okay, Martha. Easy. You've seen House. Doctors don't always wear white lab coats. Maybe they're the head of a certain department... She glanced at the call light, an action that was barely noticeable. Don't panic. See? The call light's right there if there's any trouble. Besides, the nurse must have seen this guy before he came in here. She would have stopped him if he wasn't supposed to be here, wouldn't she?
But she said this was your time for rest. Cecilia wouldn't have said that if you were supposed to be expecting a doctor
You could always ask him.

"Hello, Sir," Martha said. "Might I ask why you're in my room?"

~Lucias~
Lucias smacked his forehead when Fernando threatened him. "I'll objection you?" Why am I always stuck with the stupid ones? He opened his mouth to say something, but then Zeth interrupted by pointing out the forging of evidence. Lucias smirked at Fernando and sucked on his lollipop.
"I have no objections to moving on to Mr. Don Palochini's testimony, Your Honor," Lucias replied.

((I don't want to ruin the surprise. If it doesn't come up with more clarity, I'll reveal it when I get the chance :P)).

"Mind if I ask a question?" The man said. But before Martha could answer, he asked his question. "Aren't you Martha Fey, from that one trial, and that other trial where you fell ill? I heard some strange stuff about a mob and yourself. Here," the man took out a syringe of clear liquid, "If you don't like being sick while being talked to, this will treat your illness."
~~~~~~~~~~~~~~~
"Very well. Mr. Palochini, the detective, you may go now." After the Judge's prompt, Fernando left the stage, shaking. "Mr. Palochini, the owner, please come up to the stand."
Don coughed a nervous cough, then made his way to the stage. He had not expected such a revelation. Unfortunately for him, any intervention was out of Fernando's grasp.
((OK- just tell me it's all good and not to worry. If it's plot then I don't want to know spoilers. Just... if I'm given conflicting info- I'd like to know that it's not a mistake- that's all :) ))
Sniffing to hide his smirk, Zeth felt like a boy that had just spent the last ten minutes screaming and finally got his way. The sense of achievement was something he needed to hide in court though, cause he didn't know how resourceful this 'Don' guy was. Perhaps he had it more thought out than Fernando did?
Watching Fernando leave, Zeth kind of hoped to hear his final excuse for the missing identification number. The adrenaline buzz of waiting for his response slowly fizzled off after Fernando's frenzied panic. He knew something was up, and now he was going to finally get to the bottom of it all. Zeth's green eyes lit up in interest as the zealous Don Palochini walked up to the stand, every step he took transforming his expression into one of conviction. He was guilty of something. How much though, and was it relevant?
((I dont' want Zeth to suggest this, but has he been debriefed to be a witness? There may need to be a recess to do this. Zeth will want a full statement from him cause he doesn't trust any of Fernando's evidence now. Rosie, I'd like you to lead off the testimony when we restart. ))
"Your Honor, the prosecution requests a recess to properly prepare the witness," Lucias said. This isn't to save Don. This is just proper courtroom procedure.
~Martha~
"Yes, this is she," Martha said, studying the syringe carefully. On the one hand, the man could be telling the truth and she would be cured. On the other hand, he could be lying. If there was really poison in there...Could Martha trust a complete stranger with her life, especially since she was nearly killed before? She decided not to acknowledge the possible cure. "Your turn. Why are you in here?"
"Why does the witness need to prepare?" The Judge asked. "It seems as though as this trial may come to an end any moment. Besides, granting the prosecution's request allows the witness to make up a story regarding his name on the murder weapon, and I would like to avoid stories as much as possible. Does the prosecution any other reasons?" The Judge asked Lucias.
"They're trying to kill you." He told Martha. "It would be in your best interest to leave this hospital. You know why that nurse looked familiar to you?" He asked.
((This is a point- I was kinda hoping Don would get time to come up with a good lie to crack but maybe it's better this way. I would've thought he'd be given time to collect his thoughts though.))
"So," Zeth grinned, crossing his arms as he talked to himself, "We finally get to see the main event of this circus? He doesn't look so tough. I bet this guy is a testimony away from confessing the whole truth finally. But..." Glazing off the Don, Zeth hrmphed to himself disappointedly, "But Miss Martha... surely she was onto something that I wasn't. If there really WAS a crime lord involved with this, how close did Icarus get to the sun before the sun melted his wings?" Scratching his beard as he thought over Martha's evidence to himself. "She left a few holes open here and there which she probably meant to get back to, but she was picking apart was was going on with the family at the time... I mean... what proof do I have that the family were really actually having a meal at the restaurant? Maybe that's what it was?"
((Zeth is going to re read the autopsy- were their stomach's full? Was there any indication of them eating food? Did they test for poisoning? This is all to justify that they were actually having tea at ALL at the restaurant cause noone can prove that but the autopsy atm.))
((The Judge is not the same as the GM; if you want to persuade the Judge into allowing the recess, go ahead)).
Strangely enough, the only findings from the autopsy report are ones directly relevant to the murder. If they weren't in the restaurant, then maybe they killed the family before they thought about the food. That, or they just missed that issue entirely. Calling a recess would allow for some investigation time, but on the other hand, it would give Don plenty of time to fill the holes in his potential lies, if not the case itself.
"Hrmm..." Zeth thought out loud, analyzing the autopsy, "That's strange... I would've thought that the autopsy would confirm that they had eaten recently... that's pretty important. What do I know..." Placing his thumb and forefinger on his temples and rubbing them firmly, Zeth tried to think back on the court case. Were they actually served dinner at the supposed time of death? "Actually, they weren't..." Zeth breathed in disappointment, "Bill, the owner's son and waiter split the tea all over himself and has burns to... does he have burns to prove it?"
"Excuse me your honour! Before we question Mr Palochini, I'd like to see Bill Palochini's 'burn mark' on his chest from splitting the dinner." Zeth requested. "I believe this will be relevant to the case."
"Burn mark?" The Judge asked. "He only had a first-degree burn. He spent 5 minutes in the kitchen treating his burn. It should be fine now. I doubt that there is any sign of it at this point."
"Hm..." Lucias said. "No, I cannot think of another reason for a recess at the moment, but perhaps the defense can. What do you think, Mr. Gant?" It seems he could use one to get more evidence, but that's just me...Will he risk Don being able to cover his ass for updated evidence, or won't he?
~Martha~
"Yeah. No shurl," Martha said when the man told her the mafia was trying to kill her. "...I don't know why that nurse looked familiar...But I'm not sure where to go from here. I'm pretty sure every place I've ever been is one where they are looking for me..." I feel like someone in a horror movie. "There's just one problem. I'm hooked up to this heart machine. If I unplug myself, all the nurses and doctors who hear my heart stopped beating will be here almost instantaneously."
"... Who says you need to unplug the heart monitor to achieve such a reaction?" The man asked. "Anyways, 'that nurse', as you so put it, is the daughter of the crime boss who spoke to you after Al was arrested. What do you think she threw away when she came in here, waste? I think not! No nurse would ever consider throwing away waste in a patient's room. There's plenty of trashcans in the lab. Why didn't she throw her waste away there? Just a thought."
He then waited for Martha's comment on the matter.
"Well, she certainly seemed nice enough. A little quiet though. Oh..." Martha said. "Have you ever wondered what your life would be like if you weren't a nurse?"
"No, I haven't."
Of course she would say that. Why? Because she wasn't really a nurse.
"Unplugging the heart monitor was merely an example of something that would cause such a reaction," she continued. "So, then, what did 'Cecilia' throw away?"
Martha put her hand to her forehead. Then, she smiled brightly.
"I guess that means I was onto something in court," she said, chuckling. "And by reacting strongly, you mean strong enough to kill me in all likelihood. I get it." She laughed a little longer, then sighed. "Oh, let's see...Four questions. One: who are you? Two: how do you know this? Three: how can I get out of here? And four: where the heck am I supposed to do when I get out of here?"
"One:," he put up a finger, "no way in hell I'm telling. Two:," he put up yet another finger, "spies, informants, and the like, including surveillance and recon. Three:," yet another finger, ".... I guess you could play dead, allow me to setup a diversion. And four:," he put up his final finger, "go into hiding for a bit, until things clear up. Unless you have any better ideas....?" He asked, wondering if she actually had any ideas. "That, or you could meet up with the defense counsel for Al's case; I hear he made an interesting breakthrough."
Oh, I see, so he can know who I am, but I can't know who he is. Mental note: once the mafia is off your tail, look up as much information as possible on this man.
"Play dead? Like a dog?" Martha asked. She then smiled. "That should be easy enough for me to do. I already nearly died twice today, how hard could it be to fake that kind of thing?" She then looked serious. "I don't know where to hide, so I think it would be best to meet up with the defense counsel for Al's case." After all, I would need his permission to testify...
((Sorry- I was in Australia all weekend and kinda forgot about finishing the reply I had started T.T *fails*))
"Not as yet," Zeth replied, tapping his arm with his fingers thoughtfully. "I'm sure that the questions I have will be made clearer in Mr Palochini's testimony."
Waiting for Don to take the witness stand, Zeth watched his every move. When the Don finally looked like he was ready to testify, Zeth waited him sternly for a moment longer.
What is his deal? Zeth thought to himself, Why do I get the sneaky suspicion that this 'mob' that Fernando keeps harping on about is real, and is related to him. What will he admit that I can use against him for something like that? Could I prove that the murder actually happened at the restaurant?
"Sir," Zeth suddenly started firmly after a good 30 seconds of analysing the Don, "State your name and occupation."
((I assume he has to swear to tell the truth, the whole truth and nothing but the truth etc...?))
"Yeah, everything is fine," Martha said. Then, she looked worried. "Actually, no, nothing's okay." What should I tell him? "I feel like I'm going to die soon, the room is too bright, I feel like I'm burning up, and nobody's even trying to visit me, not even my friends." If there's any time for a break down, it's now. She felt tears coming to her eyes. "And now I can't even stop myself from crying anymore."
~Lucias~
Looks like that's a "no." Oh, well. This is the point where my case is the weakest, after all. He waited for Don to take the stand, and was about for his name and occupation, but the defense asked before he had the chance. Why do I have the urge to say, "Try that again, with feeling?" Better not say that. Smart aleckness isn't suitable for a courtroom. Leave the taunts for after the trial. For after the 'not guilty' verdict.
((Speaking of bad guys...))
"Very well then, the court rejects the motion for recess." The Judge announced, before Zeth began his examination.
Speaking of which, Don started hyperventilating when Zeth was studying him; noticeably after Zeth asked for his name and occupation. "Are you ok?" The Judge asked.
Don took a deep breath in, then out. "I'm sorry, your Honor, and I know what you're thinking, but this is just too much stress for me. In order to testify properly, I'll need a break. Not to prepare, but just to relax. Things are already looking bad for my restaurant, and the fact that the defense found my gun will make things worse."
"Is that gun used for self-defense?"
"Yes."
The Judge thought a moment, nodded, then spoke. "In that case, this court calls a 15-minute recess. That should be long enough for the witness to relax his nerves."
The audience, upon the Judge's announcement, started filing out of the courtroom.
The nurse rushed to Martha's bed, but before doing anything, he noticed the man's fluid-filled syringe. "What's this?" He asked, picking it up.
Martha had no clue what to say. Should I try to lie?
"They told me it was a cure," Martha said, doing her best to sound slightly crazy. "The nurse told me it would cure me. That I wouldn't have to worry about dying anymore if I let her inject me with this..." She looked at the liquid-filled syringe. "I...Couldn't stop her...She convinced me." She looked the male nurse in the eyes. "She was going to inject me again, but then she thought she heard someone coming. She left, and left this behind." Martha's eyes welled with tears again. "I think she was trying to kill me."
The don's a good actor, Lucias thought. But the truth will be known eventually, whether or not he tells it right away. Even the best lies can be unwound. The judge's gavel slammed, and Lucias left the courtroom almost immediately. He had to get Al out of the Prosecution's Lobby, after all. Otherwise, there could be an...Awkward situation.
"It's just water." The nurse pointed out. "But still, who decided to inject you with water? Hang on, I gotta figure this out." The nurse said, as he left the room, leaving the syringe behind.
Al was still moping around in the Prosecution's Lobby.
Slamming his hand onto his desk firmly as the Don weaselled his way into a recess, Zeth narrowed his eyes firmly.
"And WHERE are you going, Mercad?" Zeth blasted as Lucias dashed off at the slam of the gavel, "I'm not babysitting your witness while you run off and sulk about your limp wristed case! Do your case a favour and take Palochini with you!" Crossing his arms, Zeth frowned. There was no way he was going to let Don dash off and converse with Fenando over evidence. "You are going to take this man to the Prosecutor's lounge, give him a glass of water and talk to him one on one now and sort out this monkey show of a case. I will deal with your visitor." Pushing his glasses back up his nose, Zeth held a cool glare for a moment to tell Lucian that he meant buisness. Hoping that the prosecutor had some honour and could tell that Fernando was a crook, he hoped that he wouldn't let the father and son near each other before the metal bars of prison brought them back together.
Hey, apparently Lucias Mercad is a good and honourable man. Zeth's stern face turned into a neutral smirk as he turned firmly towards the prosecutor's lounge and strode off. As he passed Lucias on the way to the lounge, Zeth paused beside the prosecutor.
"I hope you've been paying attention this court case, Mercad," Zeth started, taking his mike away from his lapel, "I don't want you to let that man out of your sight- you hear me? I dont' care if you think he's guilty or not."
Martha looked at the man hiding behind the door and mouthed, "Just water?" She then chuckled softly. "I can't believe I lied to that guy..." She picked up the syringe. "Syringe added to Court Record," she said with a slight laugh.
Lucias clenched his fists slightly, biting off part of his lollipop. If there was anything he didn't like, it was being told what to do. Much less by a defense attorney. "I hope you've been paying attention to this court case, Mercad." God, how he hated being called Mercad. At least put a Mr. before it, for crying out loud. "I don't want you to let that man out of your sight- you hear me? I don't care if you think he's guilty or not." Lucias cast Zeth a cold glare. Then, sighed.
"Very well. Make sure my visitor is out of the Prosecution's Lobby by the time Mr. Palochini and I get there," he said. He then walked over to Don Palochini. "Mr. Palochini, please come with me and explain what is going on." Unlike Mr. Gant, I actually believe in being somewhat courteous to everyone, regardless of how I am doing in the courtroom. My case is circling the drain, which I suppose I knew would happen. Then again, I wonder if Ms. Fey would have done as well as Mr. Gant seems to be doing.
